Cardillo Gray Partners successfully litigated, against TAL, a claim on behalf of a former police officer in receipt of a damages settlement. TAL had offset the former officer’s damages against her income protection entitlements reducing her benefits to effectively zero. His Honour Justice White held that damages did not fall within the categories described in the offset clause and the former officer was entitled to continue to receive her income protection entitlements.
